These Terms and Conditions are a binding agreement between you and HomeInsureHelp.com

These Terms apply to HomeInsureHelp.com and any related pages, forms, landing pages, quote-request tools, chat features, AI tools, phone calls, SMS/text messages, emails, advertisements, referral services, and other online or offline interactions that link to or reference these Terms.

1) Contract Summary — plain-English, non-binding aid

This summary is provided to make these Terms easier to understand. It is not a complete statement of your rights or obligations. If this summary conflicts with the detailed Terms below, the detailed Terms control.

HomeInsureHelp.com is an informational and referral platform. We help connect consumers with independent licensed insurance agents, agencies, brokers, insurers, or other insurance specialists. We are not a government agency, FAIR Plan, insurer, underwriting company, managing general agent, claims administrator, or policy issuer.

Coverage and product availability vary by state, property, carrier, underwriting guidelines, market conditions, binding restrictions, eligibility rules, and other factors. No insurance coverage is effective unless and until it is issued or bound by a licensed carrier or licensed insurance professional and you receive written confirmation from that carrier or licensed professional.

Do not cancel, replace, or reduce existing insurance coverage based only on information from the Site. Do not assume coverage exists because you submitted a form, received a referral, saw an estimated premium, used a chatbot, spoke with us, or were contacted by a referral partner.

We may receive compensation from referral partners for leads, calls, clicks, introductions, completed forms, referrals, marketing services, or other permitted activities. Compensation may influence which partners receive your inquiry or appear on the Site.

We use cookies, pixels, analytics tools, and similar technologies. Our Privacy Policy explains our data practices, including state privacy rights, opt-out choices, sale/sharing disclosures, targeted advertising, and recognized opt-out preference signals such as Global Privacy Control where required.

If you submit a quote request, referral request, contact form, or similar inquiry, you authorize us to respond to your request. Any required consent for marketing calls or texts using automated technology, prerecorded voice, artificial voice, or similar tools should be collected through the disclosure shown at or near the form where you submit your information. Message and data rates may apply. You can opt out of texts by replying STOP or by using any other reasonable opt-out method.

We may use automated tools, including AI assistants, chatbots, routing tools, and similar technologies. These tools are for informational, administrative, or routing support only. They are not licensed insurance agents, and their outputs may be incomplete, outdated, or inaccurate.

Disputes between you and us are generally resolved by binding individual arbitration, with a small-claims court option, unless an exception applies.

By using the Site, you agree to these Terms and to our Privacy Policy, which is incorporated by reference.

2) Acceptance of Terms

By accessing or using the Site, submitting information, creating an account, clicking a button, communicating with us, using a chat or AI feature, responding to a message, or otherwise interacting with us, you agree to these Terms.

If you do not agree to these Terms, do not use the Site.

If you use the Site on behalf of another person, property owner, business, trust, estate, company, or other entity, you represent that you have authority to do so and to provide the information you submit.

If you are an agent, agency, broker, carrier, vendor, affiliate, marketing partner, referral partner, or other business user, additional partner, vendor, advertising, referral, or data-processing terms may apply. If those additional terms conflict with these Terms, the more specific written agreement controls for that relationship.

3) Who We Are and What We Do

The Site provides informational content and a platform for consumers to request help connecting with independent insurance-related providers.

We are not a government agency, state FAIR Plan, residual market plan, insurer, underwriting company, managing general agent, claims administrator, or policy issuer. We do not underwrite insurance, bind coverage, issue policies, cancel policies, adjust claims, determine eligibility, determine premiums, or make final coverage decisions.

Unless we expressly identify a licensed producer by name and license number, we are not acting as your licensed insurance agent, broker, producer, adviser, or agent of record.

Any insurance-related services, quotes, applications, advice, policy recommendations, binding decisions, underwriting decisions, coverage determinations, premium calculations, claims decisions, or policy documents are provided by independent third parties, not by us.

The Site may include information about homeowners insurance, high-risk properties, wildfire risk, coastal risk, nonrenewals, FAIR Plans, residual market plans, surplus-lines markets, admitted and non-admitted carriers, difference-in-conditions coverage, excess coverage, or other insurance-related topics. That information is general education only. It is not legal advice, insurance advice, coverage advice, or a recommendation to buy, cancel, replace, or change coverage.

The Site is directed to users located in the United States. We do not represent that the Site or services are appropriate or available outside the United States.

4) Important Insurance Disclosures

No content on the Site is an offer to sell insurance or a promise that coverage is available.

Any quote, premium indication, estimate, savings estimate, eligibility indication, comparison, referral, market description, or coverage discussion is preliminary and subject to change. Actual availability, pricing, coverage, deductibles, exclusions, limits, endorsements, inspections, underwriting, carrier rules, state rules, property condition, claims history, loss history, credit-based insurance scoring where permitted, catastrophe exposure, wildfire or coastal risk, occupancy, roof condition, prior insurance, payment status, and other factors may affect the final result.

Coverage is not bound unless and until a licensed carrier or licensed insurance professional confirms binding or issuance in writing. A completed web form, phone call, email, text message, chat, AI response, referral, uploaded document, or estimated quote does not create coverage.

Do not rely on the Site for policy changes, cancellations, claim reporting, proof of insurance, compliance with lender requirements, renewal deadlines, nonrenewal deadlines, cancellation deadlines, moratorium deadlines, escrow requirements, closing deadlines, or any urgent insurance matter. Contact your current agent, carrier, lender, escrow officer, or state insurance regulator directly for time-sensitive issues.

We are not responsible for carrier binding restrictions, catastrophe restrictions, wildfire restrictions, named-storm restrictions, underwriting moratoriums, inspection outcomes, third-party delays, market withdrawals, state program requirements, or referral partner decisions.

If a referral partner offers surplus-lines, non-admitted, excess, FAIR Plan, residual market, or other specialty coverage, ask the licensed producer about state-specific rules, taxes, fees, assessments, exclusions, cancellation rules, guaranty-fund availability, and coverage limitations.

We do not guarantee that you will qualify for insurance, receive a quote, receive the lowest available premium, receive better coverage, avoid a FAIR Plan, replace a FAIR Plan, or obtain coverage from any particular carrier.

5) Referral Partners and Compensation

We may refer your inquiry to independent agents, agencies, brokers, insurers, wholesalers, managing general agencies, marketing partners, call centers, or other referral partners.

Referral partners are independent third parties. They are not our employees, agents, partners, joint venturers, or legal representatives unless a separate written agreement expressly says otherwise.

We may receive compensation from referral partners for leads, clicks, calls, introductions, completed forms, marketing services, appointments, referrals, or other permitted activities. Compensation may be flat-fee, performance-based, volume-based, market-based, or otherwise vary by partner, state, product, or transaction, to the extent permitted by law.

Compensation may influence which referral partners receive your inquiry, appear in search results, are prioritized, or contact you. We do not represent that every available carrier, agent, agency, broker, market, policy, or coverage option is included.

Referral partners may provide their own terms, privacy policies, disclosures, consent language, licensing information, compensation disclosures, and insurance documents. Your dealings with referral partners are between you and those third parties.

6) Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Site.

You may use the Site only for lawful purposes and in compliance with these Terms.

If you provide information about another person, phone number, property, policy, insured, borrower, co-owner, tenant, trust, estate, business, or entity, you represent that you have the right and authority to provide that information and to authorize us and our referral partners to use it as described in these Terms and our Privacy Policy.

7) Accounts

Some features may require an account. If you create an account, you must provide accurate information, keep your credentials confidential, and promptly notify us of any suspected unauthorized use.

You are responsible for activity under your account before you notify us of unauthorized access and before we have a reasonable opportunity to act.

We may suspend, limit, or terminate accounts at any time if we believe an account has been used unlawfully, fraudulently, abusively, or in violation of these Terms.

8) Limited License and Personal Use

We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site for your personal, non-commercial use and only as permitted by these Terms.

All rights not expressly granted are reserved.

You may not use the Site to build a competing product, collect leads for resale, harvest data, train models, scrape content, reverse engineer systems, or conduct commercial activity unless we have given you written permission or a separate written agreement applies.

9) Intellectual Property and Prohibited Uses

The Site and all text, graphics, logos, icons, images, videos, software, databases, forms, layouts, tools, code, workflows, compilations, and other content are owned by us or our licensors and are protected by copyright, trademark, trade secret, and other laws.

You may not copy, reproduce, distribute, publicly display, publicly perform, modify, create derivative works from, sell, license, exploit, or use any Site content except as allowed by these Terms or with our written permission.

You may not:

Frame, mirror, scrape, crawl, spider, index, harvest, or extract data from the Site except for standard search-engine indexing that follows our robots.txt instructions.

Use bots, scripts, automated tools, data-mining tools, AI agents, or similar tools to access, monitor, or copy the Site.

Interfere with Site operations, security, availability, rate limits, servers, networks, or authentication systems.

Upload malware, malicious code, spyware, ransomware, harmful files, or content designed to disrupt or damage systems.

Reverse engineer, decompile, disassemble, or attempt to discover source code or underlying technology.

Create false, fraudulent, duplicate, misleading, or abusive inquiries.

Submit another person’s phone number, email address, address, property information, or personal information without proper authority.

Impersonate any person or entity.

Misrepresent insurance needs, property details, occupancy, claims, ownership, location, prior coverage, risk characteristics, or other material facts.

Use the Site to violate telemarketing, Do-Not-Call, privacy, insurance, consumer protection, intellectual property, advertising, or data-security laws.

Use the Site to send spam, phishing messages, fraudulent leads, or unlawful marketing.

Attempt to bypass, disable, or defeat privacy choices, consent-management tools, security controls, or access restrictions.

Take any action that imposes or may impose an unreasonable load on our systems.

Use the Site in a way that harms, threatens, harasses, exploits, defames, discriminates against, or violates the rights of others.

10) User Submissions and Feedback

You may submit information, messages, documents, property details, photos, screenshots, forms, contact information, policy information, claim history, renewal information, or other materials through the Site or through communications with us.

You represent that your submissions are accurate, not misleading, and that you have the right to provide them.

You authorize us to use, copy, store, transmit, disclose, process, display, reproduce, and share your submissions as reasonably necessary to operate the Site, respond to your request, provide referrals, communicate with you, verify and document consent, prevent fraud, comply with law, enforce these Terms, improve services, and as otherwise described in our Privacy Policy.

Do not submit confidential, proprietary, or sensitive information unless it is necessary for your request. We do not intentionally request Social Security numbers, financial account credentials, medical information, biometric data, precise device geolocation, or similar sensitive information through general Site forms.

If you provide ideas, suggestions, comments, improvements, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, sublicensable license to use that feedback without restriction or compensation to you.

11) Informational Nature and No Professional Advice

All Site content is general information only.

The Site does not provide legal, tax, financial, real estate, lending, underwriting, risk-management, safety, claims, or insurance coverage advice.

You should consult a licensed insurance professional about coverage, limits, deductibles, endorsements, exclusions, replacement cost, actual cash value, wildfire or wind risk, lender requirements, FAIR Plan alternatives, surplus-lines coverage, and policy terms.

You should consult an attorney, accountant, lender, contractor, risk specialist, or other qualified professional where appropriate.

12) No Emergency or Time-Sensitive Service

The Site is not an emergency service and should not be used for urgent coverage, claim, cancellation, nonrenewal, foreclosure, closing, escrow, lender, or disaster-related deadlines.

Submitting information through the Site does not notify any insurer, agent, lender, government agency, FAIR Plan, or claims department unless a third party separately confirms receipt.

For urgent matters, contact your insurer, agent, broker, lender, emergency services, state insurance department, or other appropriate party directly.

13) Third-Party Links and Services

The Site may link to or integrate with third-party websites, platforms, tools, analytics providers, advertising partners, chat providers, payment processors, agents, agencies, brokers, insurers, FAIR Plan resources, government resources, and other services.

We do not control third parties and are not responsible for their content, policies, acts, omissions, errors, quotes, advice, coverage decisions, underwriting decisions, claim decisions, communications, or security practices.

Your use of third-party services is governed by their terms, privacy policies, licenses, disclosures, and legal obligations.

14) Communications, Consent, Calls, Texts, and Email

When you submit a form, call us, text us, email us, use chat, create an account, or otherwise provide contact information, we may contact you to respond to your inquiry, provide service-related communications, verify information, document consent, prevent fraud, process opt-outs, and manage referrals.

Marketing calls and texts may require separate consent under federal or state law. Any required consent for marketing calls or texts using automated dialing systems, prerecorded voice, artificial voice, automated technology, or similar methods should be collected through a clear disclosure at or near the point where you submit your information.

Where you provide the required consent, you authorize us and the referral partners identified in the consent disclosure, linked partner list, or other disclosure provided at the time of consent to contact you at the phone number, email address, or other contact information you provide about homeowners insurance, FAIR Plan alternatives, high-risk property insurance, related insurance products, or related services.

You understand that calls or texts may be made using automated technology, prerecorded voice, artificial voice, or similar tools where permitted by law and where required consent has been obtained.

Consent is not a condition of purchasing any product or service. You can request assistance without consenting to marketing calls or texts by contacting us at info@homeinsurehelp.com.

You represent that any phone number you provide is yours or that you have authority to provide it. If a number is reassigned, disconnected, or no longer belongs to you, you agree to notify us promptly.

We and our referral partners may record or monitor calls where permitted by law and with any required notice or consent.

15) Text Messaging Program

Message frequency varies and may be recurring, event-based, or related to your inquiry.

Message and data rates may apply.

Carriers are not liable for delayed or undelivered messages.

To opt out of texts, reply STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, UNSUBSCRIBE, or any other reasonable message that clearly communicates that you want texts to stop.

We may send one non-marketing confirmation message after receiving an opt-out request.

Opting out of texts may prevent us from providing certain text-based updates, but it does not affect your ability to request help through other available channels.

16) Email Communications

You may opt out of marketing emails by using the unsubscribe link in the message or by contacting us at info@homeinsurehelp.com.

We may still send service, transactional, legal, security, account, privacy, or request-related emails where permitted by law.

You are responsible for keeping your email address current and for checking spam, junk, or filtering settings.

17) Electronic Records and Signatures

You agree that we may provide Terms, notices, disclosures, communications, authorizations, consents, confirmations, records, and other documents electronically, including by posting them on the Site, sending email, sending SMS/text messages, displaying them through forms or chat, or using other electronic methods.

By using the Site, submitting forms, checking boxes, clicking buttons, signing electronically, or otherwise indicating assent, you consent to electronic records and electronic signatures.

You may withdraw consent to electronic communications by contacting us at info@homeinsurehelp.com. Withdrawing consent may limit our ability to provide services.

To access and retain electronic records, you need a device with internet access, a current web browser, the ability to receive email and/or text messages, and the ability to download, print, or save records. Some records may require PDF-viewing software.

You are responsible for keeping your contact information current.

These electronic-record terms apply to our communications. Third-party agents, agencies, insurers, carriers, payment processors, and other parties may have their own electronic-signature and disclosure processes.

18) Privacy, Cookies, and State Privacy Rights

Our Privacy Policy is incorporated into these Terms by reference. It explains what personal information we collect, how we use and disclose it, how long we retain it, and what privacy choices may be available to you.

We may use cookies, pixels, tags, server logs, analytics tools, advertising technologies, and similar technologies for Site operations, security, fraud prevention, analytics, advertising measurement, targeted advertising, and personalization.

Where required by law, we provide choices for sale, sharing, targeted advertising, profiling, cookies, and recognized opt-out preference signals such as Global Privacy Control.

19) AI, Chatbots, and Automated Tools

We may use automated tools, including AI assistants, chatbots, routing tools, scoring tools, form-completion tools, fraud-prevention tools, analytics tools, and other automated systems.

These tools may help provide general information, answer common questions, collect information, route inquiries, prioritize submissions, summarize communications, detect fraud, improve Site performance, or support customer service.

AI tools and chatbots are not licensed insurance agents, brokers, carriers, underwriters, lawyers, financial advisers, or human professionals. They do not bind coverage, issue policies, determine eligibility, determine premiums, adjust claims, make legal decisions, or provide coverage advice.

AI-generated responses may be inaccurate, incomplete, outdated, or based on limited information. Do not rely on AI output as a substitute for advice from a licensed insurance professional or other qualified adviser.

Do not submit sensitive personal information to AI or chat tools unless we specifically request it and explain why it is needed.

We may monitor, store, review, and use AI/chat interactions as described in our Privacy Policy.

20) Accessibility and Alternative Formats

We want the Site to be usable by a broad audience. If you have difficulty accessing content or need information in another format, contact us at info@homeinsurehelp.com.

We will make reasonable efforts to respond to accessibility-related requests.

21) Availability and Changes to the Site

We may change, suspend, limit, replace, or discontinue any part of the Site at any time without notice or liability.

We may impose limits on features, restrict access, update content, change referral partners, modify forms, or remove information at any time.

We do not guarantee that the Site will be available, uninterrupted, accurate, secure, current, or error-free.

We may use reasonable verification, fraud-prevention, and security measures, but we do not guarantee that all unauthorized activity will be detected or prevented.

24) Payments and No Consumer Fees Unless Clearly Stated

Unless clearly stated otherwise, we do not charge consumers a fee to submit a referral or quote request through the Site.

We may receive compensation from referral partners as described in these Terms.

If we offer paid products, subscriptions, memberships, premium services, recurring charges, or other paid features in the future, the price, billing terms, renewal terms, cancellation terms, refund terms, and any required disclosures will be provided before you agree to pay.

If payments are processed through the Site, they may be handled by third-party payment processors under their own terms and privacy policies. We do not store full payment card numbers unless expressly stated and handled through appropriate payment-security controls.

25) Disclaimers

The Site and all content, tools, forms, communications, referrals, estimates, AI outputs, and services are provided AS IS and AS AVAILABLE.

To the maximum extent permitted by law, we disclaim all warranties, express, implied, statutory, or otherwise, including warranties of accuracy, completeness, timeliness, reliability, availability, non-infringement, merchantability, fitness for a particular purpose, title, quiet enjoyment, and uninterrupted or error-free operation.

We do not warrant that:

The Site will be uninterrupted, secure, timely, accurate, or error-free.

Any referral partner will contact you.

Any referral partner will provide a quote.

Any quote or estimate will be accurate or final.

Any carrier will issue, renew, or maintain coverage.

Any insurance product will be available in your state or for your property.

Any policy will satisfy lender, escrow, government, HOA, contractual, or legal requirements.

Any content will identify every available insurance option, market, carrier, program, exclusion, endorsement, or coverage limitation.

Some jurisdictions do not allow certain disclaimers, so some disclaimers may not apply to you. In those jurisdictions, disclaimers apply to the fullest extent permitted by law.

26) Limitation of Liability

To the maximum extent permitted by law, HomeInsureHelp, its affiliates, owners, officers, directors, employees, contractors, agents, vendors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, enhanced, punitive, or similar damages, including lost profits, lost revenue, lost data, loss of goodwill, business interruption, loss of coverage, premium increases, missed deadlines, lender issues, escrow delays, or third-party decisions, arising out of or related to the Site, referrals, communications, AI tools, content, these Terms, or your dealings with third parties.

To the maximum extent permitted by law, our aggregate liability for all claims arising out of or related to the Site or these Terms will not exceed the greater of $100 or the amount you paid directly to us, if any, in the 12 months before the event giving rise to the claim.

These limitations apply even if we have been advised of the possibility of damages and even if a remedy fails of its essential purpose.

Nothing in these Terms limits liability that cannot be limited by law.

27) Release

If you have a dispute with a referral partner, agent, agency, broker, insurer, carrier, government agency, FAIR Plan, vendor, other user, or other third party, you release HomeInsureHelp and its affiliates, owners, officers, directors, employees, contractors, agents, vendors, licensors, and service providers from claims, demands, damages, losses, liabilities, and expenses arising out of or related to that dispute.

If you are a California resident, you waive California Civil Code section 1542 and any similar law, which provides that a general release does not extend to claims that the releasing party does not know or suspect to exist in their favor at the time of executing the release and that, if known, would have materially affected the settlement with the released party.

28) Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless HomeInsureHelp and its affiliates, owners, officers, directors, employees, contractors, agents, vendors, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

Your use of the Site.

Your submissions.

Your violation of these Terms.

Your violation of applicable law.

Your infringement or misappropriation of another person’s rights.

Your submission of false, inaccurate, misleading, unauthorized, or fraudulent information.

Your use of another person’s phone number, email address, property information, or personal information without proper authority.

This indemnity does not apply to the extent a claim is caused by our own gross negligence, willful misconduct, or conduct for which indemnification cannot be required by law.

29) DMCA and Intellectual Property Complaints

We may remove or disable access to allegedly infringing content and may terminate repeat infringers.

30) Promotions, Offers, and Beta Features

Promotions, contests, sweepstakes, special offers, beta features, pilot programs, or experimental features may have additional rules or terms.

Beta and experimental features are provided as is, may be changed or discontinued at any time, and may log activity to improve quality, performance, security, and safety.

31) Regulatory Complaints and Government Rights

Nothing in these Terms prevents you from filing a complaint, report, or request with a state insurance department, state attorney general, the Federal Trade Commission, the Federal Communications Commission, the Consumer Financial Protection Bureau, a privacy regulator, law enforcement, or another government agency.

Nothing in these Terms limits rights that cannot be waived under applicable insurance, privacy, consumer protection, telemarketing, communications, or other laws.

32) Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules, and by applicable federal law, including the Federal Arbitration Act.

This governing-law provision does not deprive you of mandatory consumer protections, insurance-law protections, privacy rights, or other rights that cannot be waived under the law of your state of residence.

33) Informal Dispute Resolution

Before filing arbitration or a lawsuit, you and we agree to try to resolve disputes informally.

To start informal dispute resolution, send a written notice to info@homeinsurehelp.com with the subject line Dispute Notice. Include your name, contact information, a description of the dispute, the relief you seek, and any relevant documents.

We may send dispute notices to the contact information you provided.

The parties will have 30 days to try to resolve the dispute informally unless a longer period is mutually agreed.

This informal process does not prevent either party from seeking emergency injunctive relief or filing in small claims court where permitted.

34) Arbitration Agreement and Class-Action Waiver

Except for claims that qualify for small claims court, claims excluded below, or claims that cannot be arbitrated by law, any dispute, claim, or controversy arising out of or related to these Terms, the Site, our communications, our Privacy Policy, referrals, AI tools, consent, calls, texts, emails, or our alleged role in any referral or third-party interaction will be resolved by binding individual arbitration.

The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules and Mediation Procedures, as modified by these Terms to the extent permitted by the AAA rules and applicable law.

The arbitrator may award any individual relief available in court, including damages, statutory damages, attorneys’ fees, costs, and injunctive or declaratory relief, where available under applicable law.

You and we waive the right to a jury trial.

You and we agree that arbitration will proceed only on an individual basis. No class actions, collective actions, representative actions, private attorney general actions, or consolidated actions are permitted in arbitration unless both parties agree in writing or unless applicable law requires otherwise.

The arbitrator has authority to decide disputes about interpretation, applicability, enforceability, and formation of this arbitration agreement, except that a court will decide whether the class-action waiver is enforceable.

If the class-action waiver is found unenforceable as to a claim, that claim must proceed in court and not arbitration, unless the parties agree otherwise.

35) Small Claims Court

Either party may bring an individual action in small claims court if the claim qualifies.

A consumer may bring a qualifying small-claims action in the county where the consumer resides or in Shelby County, Tennessee. We may bring a qualifying small-claims action in the county where you reside or where otherwise permitted by law.

36) Arbitration Fees, Location, and Procedure

Consumer arbitration fees will be allocated according to the AAA Consumer Arbitration Rules and applicable law.

If applicable law requires us to pay certain fees or costs for this arbitration agreement to be enforceable, we will do so.

Arbitration may be conducted by video, phone, documents only, or in person, as permitted by the AAA rules and determined by the arbitrator.

If an in-person hearing is required, it will take place in a reasonably convenient location for the consumer or as otherwise required by the AAA rules or applicable law.

37) Mass Arbitration

If 25 or more similar arbitration demands are filed against us or related parties by the same or coordinated counsel or organizations, the AAA’s applicable mass-arbitration, batch, administrative, or similar procedures will apply to the extent the AAA determines they apply.

To the extent permitted by the AAA rules and applicable law, the parties agree to cooperate in good faith with any process arbitrator, administrative conference, mediation process, batching procedure, fee-management process, or other procedure designed to resolve mass arbitrations fairly and efficiently.

No individual claim will be dismissed solely because it is part of a mass arbitration. Any applicable statute of limitations will be tolled for claims properly submitted in accordance with the administrator’s rules while mass-arbitration procedures are pending.

38) Arbitration Opt-Out

You may opt out of the arbitration agreement by sending written notice to info@homeinsurehelp.com within 30 days after you first accept these Terms.

Your opt-out notice must include your name, contact information, and a clear statement that you opt out of the arbitration agreement in the HomeInsureHelp.com Terms and Conditions.

Opting out of arbitration does not opt you out of any other part of these Terms.

39) Court Venue for Non-Arbitrable Matters

For court proceedings that are not subject to arbitration or small claims court, venue will be in the state or federal courts located in Shelby County, Tennessee, unless applicable law requires a different venue.

You and we consent to personal jurisdiction in those courts for non-arbitrable matters, subject to any non-waivable rights you may have under applicable law.

40) No Agency, Partnership, or Fiduciary Relationship

Use of the Site does not create an agency, partnership, joint venture, franchise, employment, fiduciary, advisory, insurer-insured, agent-client, broker-client, attorney-client, or other special relationship between you and us.

Referral partners, agents, agencies, brokers, insurers, carriers, and other third parties are independent from us.

No referral partner has authority to bind us unless we expressly agree in writing.

We do not have authority to bind coverage, issue policies, change policies, cancel policies, or make claims decisions for any insurer or referral partner.

41) Modifications to Terms

We may update these Terms at any time.

Changes take effect when posted with the updated “Last Updated” date unless otherwise stated.

Your continued use of the Site after changes are posted means you accept the updated Terms.

If we make material changes, we may provide additional notice where required by law.

42) Termination

We may suspend, limit, or terminate your access to the Site at any time, with or without notice, including if we believe you violated these Terms, violated law, submitted fraudulent information, created security risk, abused the Site, or interfered with our operations.

Sections intended to survive termination will survive, including intellectual property, user submissions, disclaimers, limitations of liability, release, indemnification, dispute resolution, arbitration, governing law, and miscellaneous provisions.

43) International Use, Export, and Sanctions

The Site is intended for users in the United States.

You may not use the Site in violation of U.S. export controls, sanctions laws, anti-money-laundering laws, or other applicable laws.

You may not use the Site if you are located in, ordinarily resident in, or acting on behalf of a person or entity in a jurisdiction subject to applicable U.S. sanctions, or if you are on a restricted-party list.

44) Records, Notices, and Contact

We do not separately file agreements with users. Please print or save a copy of these Terms for your records.

We may provide notices by posting on the Site, by email, by SMS/text message, by mail, through your account, or by other reasonable means.

45) Miscellaneous

These Terms, together with our Privacy Policy and any additional terms that apply to specific features or services, are the entire agreement between you and us regarding the Site.

If any provision is found unenforceable, that provision will be enforced to the maximum extent permitted by law, and the rest of these Terms will remain in effect.

Our failure to enforce a provision is not a waiver.

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, transfer of business, or by operation of law.

The word “including” means “including without limitation.”
